ABSTRACT

The accountability issue addresses transitional justice, which is the most contentious part of the peace process and the origin of the most intense and bitter episodes of political discussion between supporters and opponents of the negotiations. This chapter analyzes the human rights component in Colombia's final peace accords. It discusses the nature of the political conversation between parties to the conflict, both national and international actors, to present a sense of the process that finally determined the text of the accords, particularly with regard to transitional justice. The chapter considers this to be the most important component of the accords and the point at which a difficult balance was established between international norms and principles and the nature of the transition from a conflict to a post-conflict scenario. It also discusses the peace agreement in the context of international law. The chapter provides some conclusions and suggestions for future discussion.
