ABSTRACT

In 2009, two art market issues increasingly dominated legal developments in the United States and Europe: standards for restitution of looted art and antiquities, most of which had passed through the art market at one time or another, and standards for diligence and transparency in art market transactions. As in the past, questions related to the passage of time-statutes of limitation and laches-tracked along with the two predominant issues, further complicating cases coming to light through judicial decision or publicly announced settlement during the course of the year.
