ABSTRACT
This section is devoted to cultural property issues that are directed to tribes, those actions brought in tribal court based on tribal code, and Indian Arts and Crafts Act litigation. Items discussed in this section will typically include matters affecting Tribal Historic Preservation Offi cers, consultation, and programmatic agreements with agencies. Actions brought by tribes against the federal government or states are discussed in “Practice Area 1: Federal Land Management” and “Practice Area 2: State and Local.” Repatriations under NAGPRA or the Smithsonian Act are included in the “Burials and Human Remains” section in “Practice Area 2: State and Local.” In this section, the term “tribes” includes federally recognized tribes, Native Hawaiian organizations, and Alaska Native Village corporations.
