ABSTRACT

In 2005 federal criminal cases involving cultural property were noteworthy for the items involved, the statutes used to convict, and an appellate issue of fi rst impression presented. A survey of the 13 cases presented here reveals that fi ve prosecutions involved items belonging to institutional collections (Doos; Harner; Borsuk, Lipka, Allen and Reinhard; Breithaupt; and Hanson); in three of those cases, the cultural property consisted of rare books, manuscripts, documents, and other materials in libraries and repositories, including the National Archives (Harner; Borsuk, Lipka, Allen and Reinhard; and Breithaupt).
