ABSTRACT

Copyright protection is a provision in the U.S. Constitution. Copyright is not one right but in fact is a “bundle of rights.” Music authors often license their music to others, who collect royalty payments on their behalf. Derivative works have tremendous value. Only original works fixed in a tangible medium can be copyrighted. Registering a copyright is not required but provides many advantages. Even without permission of the copyright owner, works can be used if the four conditions of fair use are met. A trademark is intended to help consumers make decisions: confusing trademarks are prohibited.
