ABSTRACT

In Poland the Labour Code, 1974, as amended through 2016, includes the definition and prohibition of sexual harassment, and addresses bullying and discrimination. It aims to ensure equal treatment and prevent discrimination based on religious beliefs, ethnic origin, or sexual preference, and with respect to fixed-term or open-ended or full- or part-time employment status. Sex discrimination shall include any unacceptable sexual behavior or any behavior related to the employees' sex aimed at or resulting in violation of dignity or humiliation or abuse of an employee. Such behavior may be manifested by physical, verbal, or nonverbal elements. Sexual harassment is also prohibited. Molesting and sexual harassment are both treated as a manifestation of discrimination. Employees shall be treated equally as regards: the conclusion and termination of the employment relationships; conditions of employment; and promotion and access to training in order to raise occupational qualifications.
