ABSTRACT

The Federal Act on Equal Treatment I No. 66/2004, as amended by BGBl. I No. 7/2011, originally effective in July 2004, and amended in 2011, implemented Directive 2002/73/EC prohibiting unequal treatment of women and men and forbidding discrimination. The Act contains definitions of direct discrimination, indirect discrimination, and harassment based on EU Directive 2002/73/EC. It covers all employees in the private sector. Harassment by the employer himself/herself or by third persons is prohibited. People with disabilities are protected by a number of regulations that go beyond or deviate from the rights defined by the Federal Equal Treatment Act. The Austrian Act on Equal Treatment of Disabled Employees and the Law concerning Employment of Disabled Employees implement Directive 2000/78/EC into Austrian law, providing for non-discrimination of disabled employees. Direct discrimination, indirect discrimination, instruction to discriminate, discrimination by association, and harassment are prohibited on the ground of disability.
