ABSTRACT

The Federal Aviation Administration (FAA) was granted sole responsibility to oversee and regulate the airline industry and the national airspace for both military and commercial aircraft in the Federal Aviation Act of 1958. Since, it has become the world leader in safety promotion and regulation of airspace and has helped drive similar levels of success throughout Europe. Civil aviation throughout the world has modeled operations, standards, regulations, and structure after the FAA. As "drones" have emerged as a highly productive technology platform for a variety of industries, many interested parties operate within a vacuum of regulations. The Certification of Authorization systems allowed the FAA to closely monitor and understand all Unmanned Aircraft Systems (UAS) activity in pre-designated airspace —other than that of the hobbyist and non-compliant commercial community. The Texas legislature's balanced approach to UAS both supports growth of the UAS industry and provides limitations to law enforcement to allay fears over privacy.
