ABSTRACT

This chapter provides a snapshot of the infrastructure of international commercial dispute resolution in Hong Kong. It describes the corresponding infrastructure of two rival jurisdictions, more specifically the legal machinery and organizations supporting international commercial arbitration and alternative dispute resolution (ADR) in Singapore and Mainland China. The chapter focuses on the following aspects of the three jurisdictions: legislation, organizations, government support, judicial support and ADR Initiatives. It also considers mediation, mediation-arbitration, and adjudication. The Arbitration Ordinance governs international and domestic arbitrations in Hong Kong. The Arbitration Ordinance consists of 112 sections and three schedules. It adopted a substantial portion of the Model Law. There are numerous organizations in Hong Kong that are involved in promoting arbitration in some way. The organizations can be classified into two groups. The first group comprises institutions which administer arbitrations. The second group comprises institutes that organize conferences, seminars, workshops, and other activities to complement the work of arbitration centres and organizations.
