ABSTRACT

This chapter summarizes the provisions of five arbitration rules that an international commercial arbitrator based in Hong Kong might encounter in the course of practice. The sets of rules are: the 2013 Hong Kong International Arbitration Centre (HKIAC) Administered Arbitration Rules, the 2016 Singapore International Arbitration Centre (SIAC) Arbitration Rules, the 2015 China International Economic and Trade Arbitration Commission (CIETAC) Arbitration Rules, the 2010 United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules, and the 2017 International Chamber of Commerce (ICC) Arbitration Rules. The chapter focuses on four areas covered by these five sets of rules: appointment of a tribunal, pleadings, conduct of proceedings, and award. The latest HKIAC Rules came into effect on 1 November 2013. The Rules consist of six sections: General Rules; Commencement of Arbitration; The Arbitral Tribunal; Conduct of Arbitration; Awards, Decisions and Orders of Arbitral Tribunal; and Other Provisions. SIAC-administered arbitrations are overseen by a Court of Arbitration headed by a President and Vice-President.
