ABSTRACT

The contract of purchase and sale is widely used in relationships involving citizens. Soviet citizens daily acquire various commodities in stores and in doing so they conclude numerous contracts of purchase and sale. The reciprocity of the contract of purchase and sale distinguishes it from the contract of gift, under which property is transferred to the ownership of another person gratuitously. Under a contract of purchase and sale, a seller must transfer property to the ownership of the buyer. The most frequently concluded contracts of purchase and sale are those between a state or cooperative trading organizations on the one side, and a citizen on the other. The contract of barter, like the contract of sale, is used to transfer the right of ownership of property. The non-performance of the stipulated conditions allows the giver the right to demand the rescission of the contract and the return of the given property.
