ABSTRACT

The norms on discovery are contained in Articles 107-109 of the Principles. A discovery must touch the most basic positions of objective reality, its natural laws, properties, and phenomena: bring about substantive changes in the level of knowledge. A discovery establishes the base for subsequent inventions and has great practical significance. A special procedure is provided for formalizing the rights for discovery, which begins with the presentation of an application to be granted a certificate for a discovery to the State Committee of the USSR on Inventions and Discoveries. The non-property right of an author of a discovery is the right of authorship which may belong to one or more persons. The Committee on Discoveries and Inventions determines the amount of the remuneration and its payment, depending on the significance of the discovery. Disputes regarding the authorship of a discovery are examined under judicial procedure, and they may arise only after the application for the discovery is recognized.
