ABSTRACT

Data privacy is an elusive concept, but as a policy problem it basically revolves around the issue of how to protect personal data without unduly restricting its use or, conversely, how to use personal data without infringing the data subject's right to privacy. Data privacy has become an even more salient issue internationally in the context of law enforcement and public security. Interaction between the public and private sectors is one of the developments that have significantly affected the politics of data privacy. The data privacy policy seeks to strike a balance between competing values and interests typically by regulating how and when personal data should be available, to accommodate economic, social, or administrative needs. The balance between data privacy and other concerns is struck in the context of social, cultural, economic, and political values and interests, which may differ between societies as well as from time to time.
