ABSTRACT

This chapter considers public sector tenancies governed by the Housing Act 1985. It considers the definition of secure tenancy. The chapter discusses the statutory exclusions. It looks at the terms of secure tenancies. The chapter also considers the extent of the security of tenure enjoyed by secure tenants. It describes how a secure tenancy may be demoted and the effect of the demotion for the tenant. The chapter also discusses succession and the grounds upon which the landlord can obtain possession. It explains the eligibility of secure tenants to the right to buy and the right to acquire. The Housing Act 1996 created a right to acquire for tenants of registered social landlords. The Housing and Regeneration Act 2008 created family intervention tenancies. The landlord condition is satisfied if the landlord is: a local authority, development corporation, housing action trust, a Mayoral development corporation, an urban development corporation the Greater London Authority or the Welsh Minister.
