ABSTRACT

This chapter provides a road map to avoid legal liability for musician actions online and keep musician brand from being diluted or disparaged. Copyright not only applies to music. Copyright also applies to all original works of authorship and includes works such as photographs, textual works, film, video, sculpture, and illustrations, and the like. The Digital Millennium Copyright Act was passed in 1998 to protect copyright owners. The advent of new technology, especially online, opened opportunities for people to obtain copyrighted materials in ways that took control and compensation out of the hands of copyright holders. The chapter explores the legal implications of rights of privacy and rights of publicity law and the most likely issues artists will encounter in relation to those rights. One of the most common issues artists have with their online presence is ownership and control of pages on social media sites.
