ABSTRACT

The right to occupational health and safety is a basic employment right. Its distinction from other rights is that it directly involves the workers life and health. Hence the protection of workers occupational health and safety should be the most fundamental and urgent task. Occupational health and safety refers to the protection of workers health and safety in the employment process through relevant means adopted in respect of legislation, technology, equipment and education. In China, the right to occupational health and safety refers to the right to labour protection in a narrow sense. The Labour Law of People's Republic of China adopted the definition of labour health and safety protection' given by the International Labour Organisation (ILO), to make it clearer and more specific than the notion of labour protection. The violation of workers' rights to occupational health and safety is a widespread issue across the world but in developing regions the problem is strikingly severe.
