ABSTRACT

Workers' right to dignity in the workplace can indeed be protected. There are also examples of positive employers eliminating workplace bullying. We also know from harassment studies that there are, at a minimum, steps that employers can take to limit the amount of workplace bullying. The rates of bullying and the rates of ongoing levels of unlawful harassment indicate that American employers are not effectively addressing the issue of workplace harassment let alone the broader issue of workplace bullying. Targets of workplace bullying have no adequate avenue of recourse available in the US employment system. The US employment law system clearly fails to present an effective solution to the epidemic of workplace bullying in the United States. Employees may not only be stripped of their dignity in a workplace that falls below a "hellish" level, but they may be suffering serious physical, psychological and emotional consequences.
