ABSTRACT

Global law organizes the fundamental public/social functions. The pivots of the global legal system are: verticality, legality, integration, and collective guarantees. Global law has the value and carries out the functions of constitutional law in the domestic system. It is made of the founding principles of the global community, the procedures and institutions that regulate public functions. It creates the structures and regulates the decisional processes of ascertainment and implementation of norms aimed at safeguarding global interests. The creation of global power centers is the result of the empowerment and the broadening of the institutional powers of UN organs and other international organizations. The global legal system is based on the principle of legality and on constitutional principles that address the supreme values of mankind and set obligations erga omnes for states, individuals, entities, and groups.
