ABSTRACT

This chapter demonstrates that there was nothing implicit in the US arguments. On 17 January 1993 the US, acting alone, launched several Tomahawk cruise missiles at a nuclear facility on the outskirts of Baghdad. The US revival argument has not since been witnessed in the practice or discourse of the interpretive communities outside of the context of Operation Iraqi Freedom. Life for the revival doctrine after Operation Iraqi Freedom has proved rather bleak with no real discernible signs of impact upon the jus ad bellum. The Council meeting at which 678 was adopted showed that the Member States viewed this as giving the Coalition authority to push Iraq out of Kuwait and to restore peace between the two states, not to take any wider action. Resolution 1441, adopted on 8 November 2002, provided Iraq with a final opportunity to comply with its disarmament obligations.
