ABSTRACT

Spatial notions are relevant in several ways to the application of the Law of War. It examines whether an incursion made into the territory of a State that it can be established that the territorial rights of a State have been violated, activating the Law of War. Certain States have, by tradition, conducted a neutral foreign policy. Sweden thus has declined to join NATO but claims to have a close relationship, cooperating in the Partnership for Peace together with NATO, non-NATO countries in Europe, Central Asia and Northern Caucasus. Sweden is member of the Euro-Atlantic Partnership Council (EAPC), a body which provides a framework for exchange of information and security questions. After the Palestinian-Arab violence in 2002, Israel began construction of a barrier that would separate most of the West Bank from areas inside Israel. The ICJ found in its Advisory Opinion on Construction of a Wall in occupied areas, that such a wall was contrary to international law.
