General Human rights include the right to marry and found a family.1 The new concepts of ‘rights’ notwithstanding, marriage has been part of the law of Scotland as far back as we have knowledge. However, the religious elements that formerly undergirded or were assumed to justify the law have diminished to the point of irrelevance. No area of the interaction of church and state in Scotland has shown more change, and the rate of change has accelerated since the 1970s.
