ABSTRACT

This chapter focuses on the involvement of experts in the hearing of cases in the Netherlands. Three types of court are explored: the Agricultural Tenancies division of the District Court, the specialized court that hears cases concerning the execution of sentences and the Company and Business Court in Amsterdam. As an independent judicial authority, the Companies and Business Court that forms part of the Amsterdam Court of Appeal has specific jurisdiction on legal disputes on all sorts of business-related issues. The Execution of Sentences division of the Arnhem Court of Appeal consists of three judges and two experts in the mental health domain: a psychiatrist and a psychologist who are knowledgeable in the forensic field. The Agricultural Tenancies division of the District Court decides disputes regarding agricultural tenancy contracts. Finally, it concludes these courts fit very well in the Dutch professionalized legal system, and the participants are very contented with the way they operate.
