ABSTRACT

This chapter provides an overview of the development of human rights legislation and the duty to accommodate provision in Canada as it pertains to employment. Disability management focuses on the integration and participation of people in the protected group in competitive employment through proactive involvement and accountability of key stakeholders. In Canada, human rights legislation is applied and interpreted by a human rights tribunal, human rights panel or board of inquiry. However, as outlined in MacNeill, human rights adjudicators may include any and/or all of the following: human rights commissions/tribunals/boards of inquiry, labour arbitrators, employment standard adjudicators, occupational health and safety adjudicators, labour relations boards and police service boards. With respect to the employment relationship, provincial or territorial legislation has jurisdiction in their respective province or territory with the exception of matters that fall under the constitutional jurisdiction of the federal parliament.
