ABSTRACT
The key aim of the Act was to mainstream and embed equality practice in routine policy formulation, implementation and review processes. The chapter adopts the expression 'acquiring authority' to describe the relevant entity utilising vesting powers. A challenge under Schedule 6 is by way of statutory review and thus should be by way of originating notice of motion under Order 55 of the rules of court. Once the vesting order is operative, the interests of any former owners are converted to a right to be compensated. This is the end of the matter, almost, but perhaps not quite. The operation of planning law can place restrictions on the possible use to which land is put and, consequently, may have a detrimental impact on the value of the land. The chapter provides a broad overview of the application of the core procedural and compensatory principles of compulsory acquisition in Northern Ireland.
