Principles of contract law In contract law a claimant who makes a claim for damages is under a duty to mitigate his loss. This is, however, not a duty in the sense that he can be sued if he fails to do so, because the effect of a failure to mitigate is that the claimant cannot recover damages in respect of the portion of his loss that is attributable to his own conduct or lack thereof.
