ABSTRACT

The Jerusalem Old City Initiative (JOCI) strives to identify sustainable governance solutions for the Old City of Jerusalem, one of the most sensitive issues in the Israeli–Palestinian conflict. This chapter examines the role of the Special Regime (SR) with respect to property ownership and rights and considers the Special Regime's involvement in the management of archaeological activities in the Old City. Al-Jubeh and Seidemann have described in some detail the diversity of owners and types of ownership at play in the Old City. Most of the attention concerning post-conflict housing and property rights has fallen to the question of restitution – ensuring the provision of justice for those who suffered property rights deprivations during the conflict. The difficulties of engendering credibility for an internationalized post-conflict property mechanism were seen in Kosovo as well. At the end of the SR there will be little or no evidence of contracting in property outside of the SR framework.
