ABSTRACT
This chapter explores the consolidated group of contract terms and conditions by states and local government agencies is likely to identify new provisions to add to their existing terms and conditions or improvements to existing terms and conditions. The Model Services Contract (MSC) in Appendix D, Best-Practices MSC, includes an attachment containing all fifty of the terms and conditions, minus the commentary, in a single document. The American with Disabilities Act (ADA) is a federal law designed to prevent discrimination against persons with disabilities. Federally funded contracts are likely to require flow-down of ADA contract provisions to contractors and subcontractors. Copyrights provisions occasionally require the contractor to pay all fees associated with copyright infringements, provide alternative products or services that do not infringe on copyrights, and terminate the contract at no cost to the agency.
