ABSTRACT

It is unfair to say that the English courts have not achieved any progress on the illegality issue in marine insurance, and the status of the current law in England is fast-changing. In Law Commission Report No 353, the Law Commission proposed reform of various controversial areas in insurance law, including the areas of good faith, fraudulent claims and warranties. The Insurance Contract Law Bill 2014 (now the Insurance Act 2015) was drafted according to this reform report, in Part 3 of which the warranty issue was considered, with section 9 being concerned with warranties and representations and section 10 with breach of warranty.
