ABSTRACT
Section 9 of the Act entitles the Minister to prepare and publish a Code of Practice governing the conduct of adjudications. Stakeholders such as The Construction Industry Federation, Engineers Ireland and other representative bodies of the relevant professions were invited to comment upon a number of drafts of the Code of Practice and following such comments the Code of Practice was passed into law on the 5th July 2016 but quickly revoked and replaced by a second Statutory Instrument on the 25th July 2016. These Statutory Instruments contained a number of provisions that were not included in earlier drafts. The stakeholders were not given an opportunity of commenting upon some of the provisions that are considered least desirable by the author such as the new elements contained in paragraphs 8 and 11 as set out below.
