ABSTRACT

This chapter describes what existing principles and factors are available to the discourse of international water sharing from the international water law perspective. It describes how the issue of scale impacts on our notions of water justice. The chapter examine, through elimination, what existing justice and moral theories and principles or existing sources of knowledge are available to assist us making decisions about right and wrong from a philosophical perspective. Each perspective is applied in a transboundary water context. It explores how this philosophical approach can assist us in understanding water justice in the context of international water allocation decision-making. International water law provides us with the concept of limited territorial sovereignty as a basis upon which to build principles of water allocation and sharing between states. International water law in general and the UN Watercourses Convention in particular certainly provide a comprehensive framework for water allocation decision-making.
