ABSTRACT

This chapter discusses the approach of the European Union (EU) to integrated water resources management (IWRM) by means of the Water Framework Directive. It discusses the specific topics in EU water law, starting with the river basin approach, followed by the environmental goals. The chapter also discusses the new design of water legislation within the EU, giving special attention to the tension between flexibility and effectiveness. The Water Framework Directive is a major step forward in IWRM. Its innovative and adaptive approach, which pays specific attention to the protection of aquatic ecosystems, and the great emphasis on involvement of the public in all stages of the policy process, were a source of inspiration for many countries across the world. The achievement of good status of all European waters implies actions outside the realm of water law. In line with the United Nations Economic Commission for Europe Aarhus Convention, EU water law contains mandatory disclosure provisions and encourages public participation.
