ABSTRACT

Advertising typically takes one of two forms. Commercial advertising (sometimes referred to as “commercial speech”) deals with products and services, while political advertising deals with the candidates for public office and issues being debated in society. Based on seven decades of Supreme Court decisions, commercial advertising is considered to be of less value than political advertising and is subject to considerably more regulation. Political advertising, considered a form of political speech, receives a high degree of First Amendment protection and is subject to much less regulation.
