ABSTRACT

This final chapter examines war crimes and their significance in underpinning the entirety of IHL. Part 2 takes on the foundational task of defining what a war crime is, principally by walking through the historical development of the term itself. Part 3 then shifts to the distinct category of grave breaches. Part 4 visits the triggering equation for war crime accountability: the existence of an armed conflict and a nexus between the alleged conduct and that armed conflict. Part 5 addresses who can be held responsible for war crimes, and Part 6 ends the chapter with a discussion on amnesties.
