ABSTRACT

This chapter addresses the specific topics of neutrality and naval warfare, which incorporate several unique considerations. Part II introduces the sources of law that may be applicable during naval warfare, such as the law of neutrality. A quick transition to Part III shifts the chapter to a classification of waters discussion, where terms such as national waters, international waters, innocent passage, and transit passage are explained. The status regime of vessels and aircraft is also introduced. Part IV narrows in on the specifics of the law of neutrality, chiefly the rights and obligations of neutral States, and the belligerent States encountering them. Part IV addresses the applicability of IHL during naval warfare, and Part VI on special tactics of naval warfare, such as blockades, exclusion zones, submarine warfare, and sea mines. Lastly, the chapter concludes with Part VII’s discussion on protecting the wounded, sick, and shipwrecked during naval warfare.
