ABSTRACT
Human rights are those conditions necessary for one to be a person. The destruction of human rights is a fact that cannot be concealed in China. The order protecting human rights by the People Government on April 20 is ironclad proof of acknowledgment that the human rights of the Chinese people have already been destroyed. The state function is to protect human rights, to protect those necessary conditions for citizens being persons. Law is created in order to protect human rights. The fundamental purpose of law is to protect human rights. One can divide law into two types, they are constitutional law and common law. Constitutional law is that law whereby the people control the government. Common law is that law whereby the government controls the people. In a state under the rule of law, the government controls the people, and the people simultaneously control the government.
