ABSTRACT

Abstract: This chapter presents an empirical study of the performance of Uniform Domain-Name Dispute Resolution Policy (UDRP) providers. In contrast to most empirical studies of the UDRP, which analyze the resulting verdicts in each case, we concentrate on the general performance of the different private providers, taking into account efficiency considerations. We use duration econometric analysis of the cases handled by these providers as the main variable to measure the general efficiency of each provider. From our empirical analysis, we conclude that there are important differences in performance among the UDRP providers. We found that the providers have different processes and technologies for resolving cases, giving rise to opportunities for forum shopping. This result supports claims of forum shopping in the UDRP regime, even though, in this case, the forum shopping is based on important institutional differences among the providers, instead of simple bias toward the complainants.
