ABSTRACT

This chapter deals with the specific protection which legislation provides for employees on part-time or fixed-term contracts. A considerable proportion of employees, however, work part-time under a variety of contractual arrangements, or on contracts stated at the outset to last for fixed terms. In some cases, an employee's contract may be both part-time and for a fixed term. Protection for part-time employees is derived from the Part-Time Workers Regulations 2000, which implement the EU Part-time Work Directive. As in the case of part-time employees, protection for employees on fixed-term contracts is available under Regulations which implement an EU Directive. The Fixed-Term Employees Regulations 2002 give effect to the Fixed-Term Work Directive 1999. Like the Part-Time Regulations, the Fixed-Term Employees Regulations make it unlawful to treat a fixed-term employee less favourably than a comparable permanent employee except when such treatment is objectively justified.
