ABSTRACT

The law, civil liability, and American jurisprudence are dynamic. As societal conditions change, so do our laws. These changes manifest shifts in legal thinking, establishment of legal standards, and application of these standards to activities of personnel in the criminal justice system. This text has illustrated emerging areas that place criminal justice personnel today in a more vulnerable position of civil liability than in the 1960s. In this chapter, several apparent shifts in civil litigation in criminal justice agencies are addressed in order for practitioners to consider the best possible ways to avert future legal claims.
