ABSTRACT

Critically, while Keller was Chief Judge of the court, she was not the duty judge assigned to receive appeals that day. Judge Cheryl Johnson was the duty judge and she and two fellow judges were aware that an appeal was expected and were waiting after five for it to arrive. When Ed Marty called Judge Keller to ask if the court should be held open, she said closing time is 5pm, and Johnson was not informed. Keller later said she was just making an administrative point, the office closes at 5pm, not closing the wellknown path of presenting appeals to a duty judge after hours.
