ABSTRACT
When a case is brought or to be brought in the courts of the United Kingdom, and a question of jurisdiction arises, the point of departure will be the impact of the Brussels I Regulation. For proceedings commenced before 10 January 2015 this will mean Regulation 44/2001,1 the basic jurisdictional provision for all proceedings instituted on or after 1 March 2002.2 For proceedings commenced on or after 10 January 2015, this will mean the recast Regulation 1215/2012,3 the jurisdictional rule for all proceedings in civil and commercial matters instituted on or after that date.4
