ABSTRACT

Under the Children Act 1989, the local authority has duties to promote the welfare of children in their area. This may involve providing services for children in need or applying for compulsory court orders to protect these children from harm. This chapter presents a checklist for students to help them to understand and apply the rules for various property disputes. These include the following: the background to the Children Act 1989 and how this has influenced the no order principle; the duty to investigate child abuse in a private law case under the Children Act 1989 s 37; and the effects of the emergency protection order, including parental responsibility and the exclusion order under the Children Act 1989 s 44A. The chapter also presents three points for common pitfalls, a question on an arrangement under the Children Act 1989, the answer to this question and the application of the law.
