ABSTRACT

This chapter examines the issue of environmental justice at both international and national levels in the context of shipbreaking. It conceptualises environmental justice in the context of the shipbreaking industry. The chapter explains environmental justice, mainly relying on Amartya Sen's Idea of Justice, particularly using the concept of nyaya or a 'comprehensive concept of realized justice'. It also examines the concept of environmental justice under international law. The chapter discusses the concept of environmental justice in the context of Bangladesh. It explores the relationship between fundamental rights under the Constitution of Bangladesh – particularly the right to life – and environmental justice in the shipbreaking industry. The chapter argues that in the context of the Bangladeshi shipbreaking industry, implementation of socio-economic rights is inherently interlinked with ensuring environmental justice. It presents the relationship between environmental justice and the implementation of principles of international environmental law in the context of international legal frameworks for environmentally sound disposal of end-of-life vessels.
