ABSTRACT

The Court of Justice of the European Union (CJEU) stated that the directive was to facilitate the exercise by lawyers of the freedom of establishment and it precluded a prior test of linguistic knowledge. The company law of each Member State has developed through its own legal and political traditions, and hence there are wide variations, not only in terms, but also in concepts. This is specifically mentioned in Art 50 TFEU where action is to be taken by means of directives. The Treaty on the Functioning of the European Union (TFEU) has, one of its basic freedoms, that of the ability of individuals to move between Member States in order to carry out certain activities. The Treaty specifies three situations, namely, the free movement of workers - Art 45 TFEU, the right of establishment - Art 49 TFEU and the freedom to provide services - Art 56 TFEU.
