ABSTRACT

It is important to demonstrate the links between the right of the EU citizen and the free movement of workers, the right of establishment and the provision of services. Very often, there are problem questions associated with the rights of workers and their dependants to move around the EU in order to search for work or take up offers of employment. The starting should be the Art 45 TFEU, the directives and regulations adopted to provide the detail for the EU freedom and the judgments of the Court of Justice of the European Union (CJEU) which have developed the principles of interpretation and application of Union law. Under EU law, there is a freedom of movement for workers to move around the Union to take up offers of employment. This is based upon Art 45 TFEU and the associated secondary legislation which has been issued to provide the detail necessary to identify the specific rights of the EU worker.
