ABSTRACT

In 1992, the Colorado-based company Gates Rubber fi led a lawsuit against Bando Chemical Industries, accusing them of stealing trade secret information, specifi cally two computer programs ( Gates Rubber Co. v.  Bando Chemical Industry , 1996 ). Both companies were competing against one another in the industrial belts market, and Bando Chemical Industries hired several former employees of Gates in 1988. Gates believed that two computer programs were stolen and copied by the former employees, who were now using the computer programs under a different name. Gates sued for copyright infringement, embezzlement of trade secrets, and breach of contract ( Gates Rubber Co. v.  Bando Chemical Industry , 1996 ).
