CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999 15.44 These days, the collateral contracts have gradually been replaced (but not entirely) by rights under the Contracts (Rights of Third Parties) Act 1999 under which rights are defined and established under the original contracts with the construction and design teams. The JCT 2005 (now 2007 reprint) regime offers this as an option to collateral warranties.
