ABSTRACT

This chapter explains and explores third party entitlement agreements, known as TPE, in the context of agents and intermediaries, identifying their centrality in the process. Following the historical evolution of this practice, the different types of TPE are presented and how agents operate within these practices is discussed. Case studies are presented to give an exhaustive analysis of this phenomenon, which is becoming widespread in the football industry. Finally, the chapter concludes by introducing the reasons for the prohibition of this practice by FIFA. This chapter seeks to understand the practice more, by considering its historic development and role in the transfer market. While TPE has grown organically and therefore can take many forms, we begin by providing a general definition before looking at the nuances of other forms of financing players. Case studies are presented to give an exhaustive analysis of this phenomenon, which has become widespread in some markets.
