ABSTRACT

This chapter provides a number of observations made in General Comment no. 19 that can be further examined and considered by the Chinese authorities when making new policy and law in the area of social security. It gives an assessment of the realisation of social security rights in China in relation to international norms and standards. The current Constitution of the People's Republic of China 1982 (PRC Constitution) proclaims that the 'socialist system is the basic system of the People's Republic of China' and that citizens' right to work and right to enjoy social security are protected. Having reviewed the major achievements in terms of law-making in China, and comparing the Chinese legislation with international practice, the conclusion is that China has actually made enormous efforts and achieved significant progress in establishing a national social security system.
