ABSTRACT

Counterfeiting is just one illegal activity occurring online and having a negative impact on companies and their customers. The different techniques used to create confusion in online search include cybersquatting, typosquatting, framing, and deep linking. Administrative avenues were established to address the issue of online trademark infringement after the seriousness of online trademark infringement was identified in a 1998 study by MARQUES, the European association of trademark-owning companies, in response to a request for comments posted by the World Intellectual Property Organization. Many current problems with online infringement of intellectual property come when the consumers do not know the domain name of the company they are searching for. The most well-known infringement technique is cybersquatting, which occurs when a company or person registers a domain name consisting of a known trademark and then attempts to sell it to the trademark owner.
