Introduction to breach of trust A breach of trust may occur in many different ways. To take three examples encountered in Chapter 11 regarding a trustee’s duties : a trustee makes an unauthorised profi t in breach of his fi duciary duty; a trustee does not carry out his duties relating to investment; a trustee purchases trust property. Similarly, in Chapter 12 , regarding a trustee’s powers, we saw that if a trustee exercises a power improperly, he may be in breach of trust.
